Permitless carry is legal in Mississippi

A non-prohibited adult aged 18 or older may carry a concealed handgun without a permit (since 2016). Yes. Miss. Code Ann. § 45-9-101(24) (verified in the enrolled text of 2021 S.B. 2253, the most recent enactment amending the section) reads: 'A license under this section is not required for a loaded or unloaded pistol or revolver to be carried upon the person in a sheath, belt holster or shoulder holster or in a purse, handbag, satchel, other similar bag or briefcase or fully enclosed case if the person is not engaged in criminal activity other than a misdemeanor traffic offense, is not otherwise prohibited from possessing a pistol or revolver under state or federal law, and is not in a location prohibited under subsection (13) of this section.' The holster language was added by 2016 H.B. 786 (Mississippi Church Protection Act, effective on passage, April 2016); the purse/handbag/briefcase/fully-enclosed-case exemption dates from 2015. IMPORTANT LIMITS: (1) the carry method must be one of those listed — a holster, sheath, purse/bag/briefcase or fully enclosed case; the exemption is method-specific, not a general 'carry any way you like' rule; (2) the § 45-9-101(13) location list (courthouses, courtrooms, police/sheriff/patrol stations, jails, polling places, government meeting places, schools and college facilities, bars, airport passenger terminals, places of nuisance, places posted against carry, etc.) still applies and is NOT lifted for permitless carriers; (3) the carrier must not be a prohibited person under state or federal law. Separately, § 97-37-1(4) defines 'concealed' to exclude a pistol carried in a sheath, belt holster or shoulder holster (or scabbard/case) that is wholly or partially visible, and § 97-37-1(2) allows a person over 18 to carry concealed inside his own home, place of business, associated real property, or any motor vehicle. Subsection (24) itself states no minimum age; 18 is the practical floor because Miss. Code Ann. § 97-37-15 makes it an offense for a parent/guardian to permit a child under 18 to carry a weapon whose concealed carry is prohibited by § 97-37-1, § 97-37-1(2) uses 'over the age of eighteen (18),' and 18 U.S.C. § 922(x) bars handgun possession by persons under 18.

Getting the permit anyway is still worth it for most people: other states recognize the permit, not your residency, so without one you generally cannot carry across state lines.

Code Ann. § 45-9-101(6)(c) requires DPS, within 45 days of receiving a complete submission, to issue the license, deny it, or notify the applicant that it cannot decide within 45 days along with a time estimate. DPS's own guidance says first-time and mail-in applications take up to 45 days, while in-person renewals are generally issued the same day pending background-check clearance.

What it actually costs

The state fee is rarely the whole bill. Fingerprinting is usually charged by a private vendor, training is bought from an instructor, and several states add photographs, notarisation or other requirements on top.

The $112 commonly quoted is the $80 statutory licence fee under § 45-9-101(5)(c) plus the $32 fingerprint and background-check cost the applicant bears. No training is required for the standard permit, which is what makes the total exact. Active-duty and retired law enforcement, active-duty military and their spouses, and disabled veterans pay only the $32. Training costs apply solely to the optional Enhanced Carry Endorsement.

DPS fee schedule (Firearm Permit Fees v4, 11/4/2022): First-time permit $112.00; renewal $72.00; renewal for age 65+ $52.00. These totals combine the statutory license fee of $80.00 (renewal $40.00; $20.00 for a Mississippi resident 65 or older) under § 45-9-101(5)(c) and (12)(a) with the $32.00 fingerprint/background-check cost the applicant must bear. Fee-exempt categories pay only the $32.00 fingerprint cost, first-time or renewal: active-duty military or spouse, active-duty law enforcement, retired law enforcement, and disabled veterans (proof required — VA Veteran Health ID Card showing service-connected disability; agency letters for LEOs). Late fee $15.00 if renewed after expiration (renewal is impossible six months or more after expiration — the permit is permanently expired and the person must reapply as a first-time applicant). Duplicate/lost permit $15.00 (in person only). Security Guard Permit $132.00 new / $82.00 renewal is a separate permit type. First-time applications must be submitted in person; renewals may be mailed to P.O. Box 1459, Canton, MS 39046.

How to apply

  1. Confirm you actually need a permit. Under Miss. Code Ann. § 45-9-101(24) a non-prohibited person may already carry a pistol or revolver in a sheath, belt holster, shoulder holster, purse, handbag, satchel, similar bag, briefcase or fully enclosed case with no permit. A permit is still useful for reciprocity in other states, for NICS-exempt purchases, and as the prerequisite to the Enhanced Carry Endorsement.
  2. Check the fee schedule at https://www.driverservicebureau.dps.ms.gov/Firearms/Home — $112.00 first-time, $72.00 renewal, $52.00 renewal at 65+, $32.00 (fingerprint cost only) for active-duty military/spouse, active-duty or retired law enforcement, and disabled veterans.
  3. Download and complete form IFP-APP-01, 'Application for Concealed Carry Firearm Permit,' from https://www.driverservicebureau.dps.ms.gov/Firearms/ms-firearm-permits. Answer all Section B qualifying questions and attach the indicated supplemental forms: IFP-FORM-01 (other names / citizenship), IFP-FORM-02 (criminal charges, convictions, pardons or expungements), IFP-FORM-03 (misdemeanor domestic violence). List every residence for the past two years in Section E.
  4. Claim any Special Designation in Section C with proof: current orders (active duty military), retired military ID, VA Veteran Health Identification Card showing a service-connected disability, or two letters on agency letterhead for current/retired law enforcement confirming employment or honorable retirement plus completion of a certified law enforcement training academy.
  5. If you want the optional Enhanced Carry Endorsement, complete an 8-hour course from a DPS-certified or nationally recognized firearms instructor and attach the certificate (Section D). Current/former military with handgun combat training and retired law enforcement/corrections officers may instead attach notarized affidavit IFP-AFF-03.   6. Sign the notarized Affidavit and Release of Information (IFP-AFF-01 for initial, IFP-AFF-02 for renewal) IN THE PRESENCE OF A NOTARY. An unnotarized affidavit makes the application incomplete and it will be rejected.
  7. Apply IN PERSON for a first-time permit at a Firearm Permit Division / Driver License location. Bring a state driver's license, state ID card or federally recognized tribal ID showing your correct residential address. Fingerprints are taken at the time of application — do not apply with open or bandaged wounds on your fingers.
  8. Pay the fee. In person: cash, credit or debit card. By mail: personal check, money order, or cashier's check payable to the Department of Public Safety — never send cash.
  9. Wait for processing. DPS forwards fingerprints for state and FBI checks and sends a copy of the application to your county sheriff and, if applicable, your municipal police chief, who may submit a voluntary report within 30 days. DPS must issue, deny, or notify you of a delay within 45 days (§ 45-9-101(6)(c)).
  10. If denied, suspended or revoked, appeal to the Commissioner of Public Safety within 30 days of written notice; if sustained, petition the circuit or county court of your residence within 10 days. You may not carry under the license while an appeal is pending (§ 45-9-101(7)).
  11. RENEWAL: DPS mails a notice at least 90 days before expiration. Renew within 90 days of expiration using IFP-APP-02 (short form) if nothing about your qualifications changed, or the full IFP-APP-01 marked 'Renewal' if anything changed. A notarized IFP-AFF-02 and a full set of fingerprints are required. The first renewal may be by mail; the next must be in person, alternating thereafter so you appear in person every 10 years for a new photograph. Renewals may be mailed to Firearm Permit Division, P.O. Box 1459, Canton, MS 39046.
  12. Report a change of permanent address or a lost/destroyed license to DPS in writing within 30 days (a $25 noncriminal penalty applies for failure). A duplicate license costs $15 and requires a notarized lost/destroyed statement, in person only.
  13. While carrying under the license, carry the license plus valid identification and display both on a law enforcement officer's demand — a $25 noncriminal violation enforceable by summons otherwise (§ 45-9-101(1)(b)).

Mississippi has no state licensing, registration, or permit requirement for building a firearm for one's own personal use, and no state serialization requirement. The clearest primary-source statement is Miss. Code Ann. § 45-9-101(18): 'Nothing in this section shall be construed to require or allow the registration, documentation or providing of serial numbers with regard to any stun gun or firearm.' Mississippi maintains no firearm registry. Miss. Const. art. 3, § 12 guarantees the right to keep and bear arms while reserving to the Legislature only the power to 'regulate or forbid carrying concealed weapons.' The Legislature's posture on in-state manufacture is illustrated by 2023 H.B. 912, which declares a firearm suppressor manufactured in Mississippi from basic materials and remaining in the state to be outside federal regulation and repeals the old § 97-37-31 misdemeanor for making or possessing a muffling device — BUT H.B. 912 carries a contingent effective date (Section 7) tied to a favorable U.S. Supreme Court ruling on Texas H.B. 957 in Paxton v. Richardson, or an Attorney General determination published in the Secretary of State's administrative bulletin; I could not confirm that contingency has been triggered, and DPS still publishes the pre-2023 text of § 97-37-1 that includes 'muffler or silencer.' Do not rely on H.B. 912 as being in force. FEDERAL LAW STILL CONTROLS AND IS THE REAL RISK: an unlicensed person may make a firearm for personal use only if it is not an NFA item (no machine gun under 18 U.S.C. § 922(o), and any short-barreled rifle/shotgun, suppressor or destructive device requires an approved ATF Form 1 and $200 tax before manufacture); the maker must not be a prohibited person; manufacturing with intent to sell requires a federal license; and ATF Final Rule 2021R-05F treats certain partially complete frames/receivers and parts kits as 'firearms' requiring licensed-dealer serialization and a background check. A self-made firearm that is not serialized generally cannot lawfully be transferred to another person without first being marked. Building a machine gun, or an unregistered short-barreled weapon or suppressor, is a federal felony regardless of Mississippi law.

What we could not confirm

  • Mississippi DPS's own reciprocity FAQ page (node/51) is TRUNCATED in the state's CMS: the answer ends mid-sentence at 'Mississippi has written reciprocity agreements with the following states: Alabama,' with nothing after it. The list of written agreements therefore cannot be read from any official page. This does not affect the honors list — Mississippi's recognition of out-of-state permits is blanket and statutory under § 45-9-101(19), not agreement-dependent — but it means the state publishes no readable reciprocity table.
  • Whether 'another state' in § 45-9-101(19) reaches the District of Columbia and the U.S. territories (PR, GU, VI, MP, AS) is not addressed by the statute or by DPS. DC is included in the honors list on a plain reading, but this is an inference, not a confirmed agency position.
  • Vermont is omitted from the honors list because Vermont issues no concealed-carry license; there is no Vermont permit for Mississippi to recognize. This is a fact about Vermont, not a Mississippi exclusion.
  • No official Mississippi page states the permit's validity in years. The 5-year term comes from the statute (§ 45-9-101(1)(a)). Note the § 45-9-101(25) option (added 2021) to have the license appear as a notation on a driver's license or ID card instead of a separate card — in that case the license expires with the DL/ID rather than after 5 years. I could not confirm whether DPS has actually implemented this option; DPS's 2025 forms do not mention it.
  • The 8-hour figure for the Enhanced Carry Endorsement comes from DPS form IFP-APP-01 section D ('the qualifying 8 hour instruction'), not from the statute — § 97-37-7(2) only requires 'an instructional course in the safe handling and use of firearms.' Whether the course includes a required live-fire qualification is not published by DPS, so liveFireRequired is left null rather than guessed.
  • § 45-9-101(24) (permitless carry) states no minimum age. The 18 figure is inferred from § 97-37-1(2) ('over the age of eighteen'), § 97-37-15 (parent/guardian may not permit a child under 18 to carry), and 18 U.S.C. § 922(x). No official Mississippi source states an explicit permitless-carry age.
  • 2023 H.B. 912 (in-state suppressor manufacture; repeal of § 97-37-31) has a CONTINGENT effective date tied to a U.S. Supreme Court outcome in Paxton v. Richardson or an AG determination published in the Secretary of State's administrative bulletin. I could not verify whether that contingency has been triggered as of August 2026, and DPS still publishes the pre-2023 version of § 97-37-1 (which still lists 'muffler or silencer'). Treat suppressor manufacture as governed by federal NFA law.
  • For homeManufacture I could not exhaustively verify from a primary source that NO Mississippi statute prohibits building a firearm for personal use — Mississippi does not publish its Code on a free state-run site, and my web-search quota was exhausted before I could enumerate all of Title 97, Chapter 37. The affirmative finding rests on § 45-9-101(18) (no registration/serialization), the absence of any such prohibition in the DPS-published firearm statutes, and the Legislature's 2023 posture in H.B. 912. Confidence on that one field is medium, not high.
  • The DPS page reproducing § 97-37-7 shows a SOURCES note ending at 2011 and does not reflect the 2016+ enhanced-carry amendments verbatim; the church-carry cross-reference in § 45-9-101(13) is now to § 45-9-171 (per the 2021 text) rather than to the 2016 act. Minor cross-reference drift on the agency's reproduced statute pages.
  • Search of enacted Mississippi bills for the 2017–2026 regular sessions found no enactment amending § 45-9-101 after 2021 S.B. 2253 and 2021 H.B. 886. That search matched on bill short titles (firearm/pistol/revolver/concealed/weapon/carry/gun) rather than on code sections affected, so a differently-titled amendment could in principle have been missed.
